1. Acceptance of these terms
By accessing or using this website you agree to these Terms of Use. If you do not agree, do not use the site. The site is operated by Jobsite Funding.
2. Who may use the site
You must be at least 18 years old and acting as an authorized representative of a US business. This site and our products are offered to businesses only. We do not make consumer loans.
3. Not an offer or commitment to lend
Nothing on this site is an offer or a commitment to lend. All amounts, rates, advance rates, terms and timelines published here are illustrative ranges describing what we and our partners offer generally. Your actual terms are determined by underwriting and are stated in writing in a signed agreement before you sign it.
4. Accuracy of information you submit
You agree that information you submit is true, accurate and complete, that you are authorized to submit it on behalf of the business, and that you will correct it promptly if it changes while a file is open.
5. Authorization to verify
By submitting an application you authorize Jobsite Funding and its funding, bank, SBA and factor partners to verify the information submitted and to obtain business and personal credit reports on the business and on each guarantor, for the purposes of evaluating, funding and servicing the requested financing.
6. Electronic communications and E-SIGN consent
You consent to receive records, disclosures and notices electronically and to sign agreements electronically under the federal E-SIGN Act. You may withdraw that consent by contacting us, which may mean we cannot proceed electronically. You are responsible for maintaining a valid email address and the ability to receive and retain electronic records.
7. Intellectual property
The content, design, text, tables and code on this site are owned by Jobsite Funding or its licensors. You may read, print and share pages for your own business purposes. You may not scrape, republish, resell or create derivative commercial works from the site's content without written permission.
8. Third-party links and partner disclaimers
This site may link to third-party websites. We do not control them and we are not responsible for their content, products or privacy practices. Where a product is placed with a bank, SBA or factor partner, that partner's own terms, disclosures, fees and underwriting criteria govern the transaction with them, and we identify the partner before you sign.
9. Calculators and estimates
Calculators on this site are illustrative only. The draw-gap calculator produces an arithmetic estimate from the values you enter. It is not an offer, not a quote, and not a prediction of your approved amount, rate or line. Your actual line, rate and advance are set by underwriting.
10. No warranties
The site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that every published figure remains current between reviews.
11. Limitation of liability
To the maximum extent permitted by law, Jobsite Funding and its officers, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business, arising from your use of this site.
12. Indemnification
You agree to indemnify and hold harmless Jobsite Funding against claims, damages and expenses arising from your misuse of the site, your breach of these terms, or your submission of information you were not authorized to submit.
13. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Venue for any dispute not subject to arbitration lies in the state or federal courts located in Miami-Dade County, Florida.
14. Arbitration and class-action waiver
Any dispute arising out of or relating to these Terms of Use or your use of this site will be resolved by binding individual arbitration, and you and we each waive the right to participate in a class, collective or representative action. This clause applies to site use. The dispute-resolution provisions of a signed financing agreement govern that transaction and control over this section where the two differ.
15. Changes to these terms
We may update these terms. The effective date above reflects the current version, and continued use of the site after a change constitutes acceptance.
